Rapid City Man Sentenced 36 Months Jailtime for Driving Under Influence and Killing Passenger in Auto

RAPID CITY, SD—U.S. Attorney Brendan V. Johnson announced that a man charged with involuntary manslaughter was sentenced on July 19, 2010, by U.S. District Judge Jeffrey L. Viken. Joe Marshall, a/k/a Joe Marshall-Burritt, age 54, of Rapid City was sentenced to 36 months of imprisonment, three years of supervised release, and ordered to pay restitution in the amount of $15,731 and a special assessment of $100. Marshall was indicted for involuntary manslaughter by a federal grand jury in March 2010. Marshall was driving a vehicle while under the influence of alcohol with a BAC of .14 near Oglala, South Dakota. He lost control of the vehicle resulting in an accident in which his companion, Darla Shangreaux, was killed. This case was investigated by the Bureau of Indian Affairs Office of Law Enforcement Services, the Oglala Sioux Tribe Department of Public Safety, the South Dakota Highway Patrol, and the Federal Bureau of Investigation. Assistant U.S. Attorney Gregg S. Peterman prosecuted the case. Marshall was immediately turned over to the custody of the U.S. Marshal.
