Pennsylvania Wins Counter-Claims in Suit Over Collision With Auto.
PITTSBURGH, Pa., Nov. 20.—The Pennsylvania system, which recently announced its determination to file counter suits against motorists seeking damages as a consequence of collision won its initial case in county court here today.
On Dec. 5, 1921, a Pennsylvania flyer hit an automobile belonging to C. J. Ramsey, of Sewickley, near Dixmont. Ramsey sude for $3,000 damages, claiming his machine was wrecked. The railroad countered with a claim for $106.08. The jury returned a verdict for the defendant.
The Pennsylvania offered testimony to show the crossing gates were down and that Ramsey, unable to stop his machine, crashed through them. Damages were sought as follows: Shanty, $73.20; crossing gate, $1.62; danger sign, $9.86; and locomotive, $21.40.
A statement issued by the Pennsylvania road tonight declared that this policy will be vigorously followed in the future, whenever investigation indicates than an automobilist is responsible for damages resulting from a collision.
