AGENCY: Federal Motor Carrier Safety Administration (FMCSA), DOT.

ACTION: Notice of application for exemption; request for comments.

SUMMARY: FMCSA announces that Harris Companies, Inc. (Harris) has 
requested an exemption from the electronic logging devices (ELDs) rule 
for all its employees who are required to prepare records of duty 
status (RODS). This includes elevator technicians, electricians, other 
general laborers, and welders that operate commercial motor vehicles 
(CMVs) in interstate commerce. FMCSA requests public comment on Harris' 
application for exemption. A copy of Harris' application for exemption 
is available for review in the docket for this notice.

DATES: Comments must be received on or before January 13, 2020.

I. Public Participation and Request for Comments

    FMCSA encourages you to participate by submitting comments and 
related materials.

Submitting Comments

    If you submit a comment, please include the docket number for this 
notice (FMCSA-2019-0278), indicate the specific section of this 
document to which the comment applies, and provide a reason for 
suggestions or recommendations. You may submit your comments and 
material online or by fax, mail, or hand delivery, but please use only 
one of these means. FMCSA recommends that you include your name and a 
mailing address, an email address, or a phone number in the body of 
your document so the Agency can contact you if it has questions 
regarding your submission.

II. Legal Basis

    FMCSA has authority under 49 U.S.C. 31136(e) and 31315 to grant 
exemptions from certain parts of the Federal Motor Carrier Safety 
Regulations (FMCSRs). FMCSA is required to publish notice of exemption 
requests in the Federal Register (49 U.S.C. 31315(b)(6)(A)). This 
notice seeks public comment on the request posted to the docket 
referred to above; the Agency takes no position on its merits. FMCSA 
will review the request and all comments submitted to the docket before 
deciding whether to grant or deny the exemption.

Harris' Application for Exemption

    Harris, a family-owned and operated company comprised of an 
elevator division and an electric division, applied for an exemption 
from 49 CFR 395.8. The exemption would cover the company's 14 elevator 
technicians and electricians and seven general laborers and welders 
that operate CMVs. The company currently uses electronic devices to 
document hours of service and requested the exemption to allow it to 
resume the use of paper RODS. A copy of the application is included in 
the docket referenced at the beginning of this notice.

Request for Comments

    In accordance with 49 U.S.C. 31315(b)(6), FMCSA requests public 
comment from all interested persons on Harris' application for an 
exemption from the ELD requirements. All comments received before the 
close of business on the comment closing date indicated at the 
beginning of this notice will be considered and will be available for 
examination in the docket at the location listed under the Addresses 
section of this notice. Comments received after the comment closing 
date will be filed in the public docket and will be considered to the 
extent practicable. In addition to late comments, FMCSA will also 
continue to file, in the public docket, relevant information that 
becomes available after the comment closing date. Interested persons 
should continue to examine the public docket for new material.
