Suit Filed to Enjoin South Dakota From Retailing Fuel.
PIERRE, S. D., Aug 1 (AP).—Papers covering the White Eagle Oil Company's proposed injunction suit against South Dakota to restrain the Highway Commission from expending public money in furtherance of retailing gasoline were submitted today to Chief Justice Polley of the State Supreme Court. The action will not be considered, however, until a full bench is present.
Governor Gunderson, Attorney General B. F. Jones, State Auditor Jones and State Treasurer Driscoll also are made parties to the suit.
If an injunction were granted the suit would prevent issuance of warrants against the $100,000 of highway money appropriated for gasoline stations and equipment and would prevent the Highway Commission and the Governor from spending public money for equipment, sites or motor vehicle fuel.
Meanwhile the State continues its campaign to force lower prices, adding pressure against the privately owned companies by reopening two additional filling stations, making five now in operation. Twenty-five others will open as soon as the necessary supplies and equipment are received.
