JURY BLAMES DEAD BOY.

Publication: The New York Times
Date: 8 June 1906

Exonerates Baudoine, Whose Car Killed Him and Chauffeur.

John F. Baudoine of Mamaroneck, N. Y., whose touring car struck and almost instantly killed five-year-old Joseph Mainet of Hoffman Boulevard, Jamaica, on the afternoon of April 6, was completely exonerated yesterday by a Coroner's jury, after the jurors had listened to conflicting testimony. One witness testified that the car was “going at great speed.” Another swore that it was only going at a moderate rate.

Baudoine said he had done everything possible to avoid hitting the child.

“If it had been one of my own boys I could not have felt worse over the accident,” said he.

The jury returned the following verdict: “We find that Joseph Mainet came to his death by being struck by an automobile through the carelessness of the deceased in running into the machine. We exonerate the owner and chauffeur from all blame.”
